1. Introduction

In accordance with applicable national and European legislation, we (NF Nutraceuticals BV) are the data controller responsible for processing your personal data. Your data may be collected through our website (www.supplentia.com) (the “Website”), by email, phone, or post, as well as through our customer service and account managers. This privacy policy describes which data is collected, for what purposes, how long it is stored, with whom it may be shared, and which technical and organizational measures are taken to adequately protect your personal data. It also provides further information about how you can exercise your rights.

We reserve the right to amend this statement to comply with future legislation or to address future developments. The most current version will always be accessible on the Website.

2. Purpose

We collect personal data for various purposes. This section outlines those purposes.

2.1. Creating an account on the Website

When you, as an end customer (“consumer”) and/or healthcare professional, create an account on the Website, we will process your personal data as part of our customer management. This includes access to the Supplentia platform for professionals. The legal basis for this processing is the underlying agreement between you as a customer and us. We will retain your personal data for this purpose for up to 7 years after your last account activity.

2.2. Purchase of a product or service

The majority of personal data is collected to carry out a purchase agreement. Since we only use this data for communication related to that agreement, we do not request explicit consent. We may also use your data to send satisfaction surveys or follow-up after a product or service has been purchased. Your personal data will be kept for up to 7 years after your last purchase.

2.3. Event registration

If you register for an event, we collect your personal data based on the agreement concluded for your participation. We process your data for registration, administration, safety management, accounting, and recordkeeping. We may also use your data to send satisfaction surveys or follow-up. Your personal data will be stored for up to 7 years after your last account activity.

2.4. Analyzing Website usage and cookies

When you browse the Website, we use Google Analytics to generate statistics based on your IP address. To protect your privacy, the last four digits of your IP address are removed, making the data non-identifiable. We process this data based on our legitimate interest in improving the Website, such as identifying how much time is spent on certain pages or which elements are overlooked. Because this data is collected via Google, we have signed a data processing agreement with them (see also 4.3). We also use cookies to personalize our Website and send push notifications. 2.5. Receiving digital newsletters/offers

If you wish, you can subscribe (via the Website, customer service, or your account manager) to receive our newsletters and offers. You can choose between printed mailings (e.g., event invitations), digital mailings (e.g., newsletters or reminders to restock previously purchased products), and digital surveys. We may also use cookies to remind you to complete a purchase. We only send newsletters, offers, surveys, or satisfaction inquiries related to NF Nutraceuticals' services and products. In some cases, these mailings may be sent by specialized third-party providers. In such cases, your privacy is protected through data processing agreements (see also 4.3). Each mailing contains a reminder of your right to opt out. You can unsubscribe at any time via the link in the email or by contacting our customer service. We will retain your personal data for these purposes as long as we have your consent or until you opt out.

2.6. Analyzing the effectiveness of mailings

After we send mailings, we analyze their effectiveness through aggregated statistics. These are used to improve future communications, for example, by tracking open rates. 2.7. Profiling

If you provide explicit consent (via the Website, customer service, or account manager), we may create a profile based on your interests, site activity, and purchases. This helps us tailor our communication with you. We store this data for up to 7 years after your last account activity.

You can unsubscribe from profiling at any time via the Website or by contacting our customer service.

3. Data

3.1. Data when creating an account

When you, as a consumer and/or healthcare professional, create an account on the Website, we process your identification data (name, title, address, phone number, email address, billing and shipping addresses) and the password you choose. You may also optionally provide your company name and VAT number. If you are a consumer, you may also optionally enter the advice code of your healthcare professional. In such cases, we will process that data as well. If you create a professional account as a healthcare professional, we may also (optionally) process your professional activity.

3.2. Data related to product purchases and event registration

To execute a contract with us (as described in 2.1 or 2.2), we collect your name, address, place of residence, phone number, and purchase details. Additionally, if you are a consumer, we may request the details of your healthcare professional for statistical purposes. You are not obliged to share these details. If you have given your healthcare professional permission to access your purchase data, we will forward this data to them. We also process your email address, which—unless otherwise authorized—will only be used for communications related to your order, such as sending a track-and-trace email, registration confirmation, or notifying you about backordered products.

3.3. Website statistics and cookies

We use Google Analytics and cookies to track your website visits and click behavior. As previously mentioned, this data is not directly traceable to you. We also use cookies for authentication and to remember your language preferences. Some cookies may remind you to complete your purchase. If you do not wish to be tracked by Google Analytics, you can disable this by installing the Google Analytics Opt-out Browser Add-on.

3.4. (Email) addresses for communication

If you sign up for our mailings, your consent will be recorded in our system. We may also send you emails following a purchase, such as reminders to restock or complete your order.

3.5. Purchase data, browsing behavior, and interests

If you give explicit consent, we will create a profile based on your known data, including purchased products and stated interests. As stated in 2.6, no profiling will take place without your prior approval.

3.5. Article 7.3 GDPR – Exercising your rights

You have the right to withdraw your consent to the processing of your personal data at any time, in accordance with Article 5 of this privacy policy.

4. Measures

To safeguard your data, we have implemented several security measures, which are detailed below.

4.1. Our website

The Website is hosted within the European Economic Area (EEA). The hosting server receives automatic security updates and is isolated from other servers via a subnetwork. The Website is only accessible via an SSL-encrypted connection, which ensures that all data is transmitted securely and cannot be intercepted. Your password is stored as a hashed value, meaning it is irreversibly encrypted and useless in case of a data breach.

4.2. Our ERP system

All data (except passwords) is ultimately stored in our ERP system, which is also hosted in the EEA. The server receives automatic security updates and is isolated via a subnetwork. Access to the ERP system is secured through an SSL connection to ensure data encryption and secure transfer.

4.3. Disclosure of data

We do not allow third parties to use your personal data for their own purposes without your consent. When necessary for the purposes described above (e.g. sending mailings), we may disclose your data to carefully selected partners or third parties. This includes:

  • Logistics partners involved in preparing and delivering your purchases;
  • Service providers helping us respond to your inquiries (e.g. via social media);
  • IT providers managing systems and applications containing personal data;
  • Marketing agencies and consultants for direct marketing initiatives;
  • Data analysts supporting us in understanding purchasing behavior and interests;
  • Database management service providers;
  • Web analytics tools such as Google;
  • Companies specializing in customer satisfaction surveys.

Before disclosing your data, we sign a data processing agreement with these third parties, requiring them to process your data solely on our behalf and under our instructions. These agreements include sufficient safeguards regarding technical and organizational security. Such third parties may be located within or outside the EEA, including in countries without adequate data protection laws. In such cases, we will ensure the legality of the transfer through appropriate legal, contractual, or regulatory mechanisms.

4.4. Confidentiality

Everyone processing personal data on our behalf is bound by a confidentiality obligation.

5. Your rights

If you wish to exercise your rights (access, rectification, deletion, restriction, portability, objection, or withdrawal of consent), please contact our customer service (info@supplentia.com). We will verify your identity before handling your request and will process it as long as it does not conflict with legal obligations. For example, the right to be forgotten may be limited due to our statutory duty to retain invoices for 7 years, which prevents us from deleting your data completely.
